Well, these are strange times. It has been just over 2 years since we were all sent home to stop the spread of COVID-19. COVID is here to stay. Business including pharmacies are learning to operate under new parameters. Under these new parameters the demand for pharmacy products and services will continue to grow. And in particular, pharmacies will continue to play an integral role in keeping patients in their homes and out of hospitals. This program will focus on the most important legal issues that pharmacies will face over the next 12 months. The program will discuss the opportunities and potential pitfalls that pharmacies face as they operate in today’s everchanging environment. This program will discuss “hot button” issues including (i) the growth in providing clinical services (e.g., point of care testing), (ii) dealing with DIR fees, (iii) relaxation of the restrictions under the federal anti-kickback statute, Stark, and the beneficiary inducement statute; (iv) collaborative arrangements among pharmacies, hospitals, and physicians; (v) enforcement of the 60-Day Rule; (vi) relaxation of telehealth restrictions, and (vii) responding to PBM audits and investigations.
Learning Objectives:
1. Understand the steps the pharmacy can take to legally enter into collaborative arrangements with other providers.
2. Learn the steps being taken by government enforcement agencies to relax restrictions under the federal anti-kickback statute, Stark and the beneficiary inducement statute.
3. Be able to discuss collaborative arrangements between pharmacies, hospitals, and physicians.
